Maximum Limitation of Fines for Economic Crimes In Law Number 1 of 2023

Criminal law provisions in the colonial-era Code are no longer competent to uphold society’s sense of justice due emergence more sophisticated crimes with a variety modus operandi. This article’s study was conducted using normative legal research methodology that included statutory, conceptual, case-based approaches. The study’s findings demonstrate offers minimal protections against risks, among them crimes. If loss resulting from offense exceeds fine may imposed, rule result unfairness, especially victim. Additionally, because judges not allowed impose exceed predetermined guidelines, cap lessen deterrent effect criminals.
